1. Acceptance of Terms

By creating an account or using our Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use our Service.

2. Eligibility

You must be at least 18 years old and a resident of the United States or Puerto Rico to use our Service. By using Luna Money, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

• You must provide accurate, current, and complete information
• You are responsible for maintaining the security of your account
• You must notify us immediately of any unauthorized access
• You are responsible for all activities under your account
• One person may not maintain multiple accounts

4. Description of Service

Luna Money provides:

• Financial account aggregation and transaction tracking
• Budget management and spending insights
• Safe to Spend™ real-time spending calculations
• AI-powered financial coaching (Coco assistant)
• Automatic transaction categorization and recommendations
• Financial goal setting and tracking
• Debt management tools (OsPulse)
• Financial wellness tracking (Luna Score, daily check-ins)
• Achievement system (Little Big Wins)
• Cash flow analysis and projections
• Financial calculators and planning tools
• Enterprise account management (for business customers)
• Progressive Web App functionality

5. Subscription and Payment

Subscription Plans

We offer multiple subscription tiers with the following account limits:

• Starter: Connect up to 5 bank accounts across 3 financial institutions
• Plus: Connect up to 10 bank accounts across 8 financial institutions
• Pro: Connect up to 20 bank accounts across 15 financial institutions
• Enterprise: Custom limits and pricing available

Prices are subject to change with 30 days notice.

Free Trial

New users receive a 14-day free trial. You will be charged automatically when your trial ends unless you cancel.

Payment Terms

• Payment is processed by Stripe
• Subscriptions automatically renew unless cancelled
• All fees are in U.S. dollars
• You authorize us to charge your payment method on a recurring basis

Grace Periods

• Trial users: 3-day grace period for payment issues
• Active subscribers: 7-day grace period for payment failures
• Account suspension occurs after grace period expires

Cancellation and Refunds

• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• No refunds or credits for partial periods
• All sales are final except for technical errors or as required by law

6. User Responsibilities

You agree to:

• Use the Service only for lawful purposes
• Not attempt to gain unauthorized access to any systems
• Not interfere with or disrupt the Service
• Not transmit viruses or malicious code
• Not use the Service to violate any laws or regulations
• Not reverse engineer or attempt to extract source code
• Not use automated systems to access the Service
• Use AI features responsibly and within daily limits
• Comply with fair use policies for API access
• Report any security vulnerabilities or bugs discovered
• Maintain accurate financial information for optimal AI recommendations

7. Financial Data Connection

By connecting your financial accounts:

• You authorize us to access your financial data via Plaid
• You confirm you have the right to grant this access
• You understand we have read-only access
• You can revoke access at any time

8. Intellectual Property

All content, features, and functionality of our Service are owned by OS Financial LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service.

9. Privacy and Data Security

Your use of our Service is governed by our Privacy Policy. We implement industry-standard security measures to protect your data, but no method of transmission over the Internet is 100% secure. All analytics data is anonymized and cannot be traced back to individual users.

No Financial Advice: Luna Money does not provide financial, investment, tax, or legal advice. All information is for educational and informational purposes only.

No Warranty: The Service is provided "AS IS" without warranties of any kind, either express or implied.

Third-Party Services: We are not responsible for the actions of third-party services like Plaid or your financial institutions.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OS FINANCIAL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNTS ACTUALLY PAID BY YOU IN THE SIX (6) MONTH PERIOD PRECEDING THE EVENT GIVING RISE TO LIABILITY.

12. Indemnification

You agree to indemnify and hold harmless OS Financial LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service or violation of these Terms.

13. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including:

• Breach of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Harm to other users or the Service

14. Dispute Resolution

Binding Arbitration

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules. The arbitration shall be conducted in Erie, Pennsylvania.

Class Action Waiver

YOU AGREE THAT ANY DISPUTES SHALL BE BROUGHT IN YOUR INDIVIDUAL CAPACITY ONLY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.

Small Claims Exception

Either party may bring a dispute in small claims court in Erie County, Pennsylvania, if the dispute qualifies.

15. Governing Law

These Terms shall be governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use after changes constitutes acceptance of the new Terms.

17. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and OS Financial LLC
• Severability: If any provision is found unenforceable, the remaining provisions will continue in effect
• Waiver: No waiver of any term shall be deemed a further waiver
• Assignment: You may not assign these Terms without our written consent

18. Usage Limits and Fair Use

• AI assistant has daily usage limits that reset every 24 hours
• Excessive API usage may result in temporary rate limiting
• Account connection limits based on subscription tier
• We reserve the right to implement additional usage limits to ensure service quality

19. Enterprise Accounts

For business customers using enterprise accounts:

• Custom account limits and pricing apply
• Separate data processing agreements may be required
• Bulk account creation and management available
• Enhanced support and service level agreements
• Custom billing and invoicing arrangements
